CONCERNING
THE TENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 ON PROCEDURES FOR EXEMPTION FROM IMPORT DUTY AND EXCISE ON THE IMPORT OF GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AS WELL AS THEIR OFFICIALS ASSIGNED IN INDONESIA

THE MINISTER OF FINANCE,

Considering:

a. that the Indonesian Government (Coordinating Ministry for the People's Welfare) and International Relief and Development (IRD) signed Memorandum of Understanding (MoU) on August 2,2006;
b. that based on recommendation of the Head of International Technical Cooperation Bureau (KTLN) of the State Secretariat NO.KL.05.00/UMPP/2461 dated June 23, 2006 IRD can be stipulated as an international organization;
c. that based on recommendation of the Head of BATAN No. 0317/KS.01/III/2006 dated March 6,2006 and recommendation of the Head of International Technical Cooperation Bureau (KTLN) of the State Secretariat No.KL.05.00/UMPP/1136 dated March 22,2006, the Japan Atomic Industrial Forum (JAIF) does no longer undertake activity in Indonesia so that the delisting of the institution from international organizations securing facility of exemption from import duty is proposed;
d. that based on the considerations as meant in letters a and b, it is necessary to stipulate a regulation of the Minister of Finance on the Tenth Amendment to Decree of the Minister of Finance No. 89/KMK.04/2002 on Procedures for Exemption from Import Duty and Excise on the Import of Goods for the Need of International Agencies and their officials assigned in Indonesia;

In view of:

1. Law No. 10/1995 on Customs Affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);
2. Law No. 11/1995 on Excise Affairs (Statute Book of 1995 No. 76, Supplement to Statute Book No. 3613);
3. Presidential Decree No. 20/P/2005;
4. Decree of the Minister of Finance No. 89/KMK.04/2002 on Procedures for Exemption from Import Duty and Excise on the Import of Goods for the Need of International Agencies and their officials assigned in Indonesia as already amended several times and latest by Regulation of the Minister of Finance No. 25/PMK.04/2006;

DECIDES:

To stipulate:

THE REGULATION OF THE MINISTER OF FINANCE ON THE TENTH AMENDMENT TO DECREE OF THE MINISTER OF FINANCE No. 89/KMK.04/2002 CONCERNING PROCEDURES FOR EXEMPTION FROM IMPORT DUTY AND EXCISE ON THE IMPORT OF GOODS FOR THE NEED OF INTERNATIONAL AGENCIES AS WELL AS THEIR OFFICIAL ASSIGNED IN INDONESIA.

Article I

Several provisions in Decree of the Minister of Finance No. 89/KMK.04/2002 on Procedures for Exemption from Import Duty and Excise on the Import of Goods for the Need of International Agencies and their official assigned in Indonesia are amended as follows:

1. To amend Attachment I point V by abolishing one number, namely number 40 so that point V reads follows:

Article II
